This request, however, was rejected by the Electoral Complaints and Appeals Panel (PZAP), which described their complaint as unfounded.

The published decision shows that the panel assessed that the claims presented were not accompanied by sufficient evidence and arguments that would justify launching a new recount on a general scale.

Haxhiu and Kryeziu’s complaint was directed against the Central Election Commission (KQZ), with a request that all votes for PDK parliamentary candidates be reviewed.

Both candidates had expressed doubts about the way the counting had been conducted, requesting additional verification of the results already published.

In its reasoning, PZAP stressed that a request for a recount must be supported by concrete facts and convincing evidence capable of proving irregularities that directly affect the election result. According to the panel, in this case the complaint did not meet that legal standard.

In this situation, the question arises as to whether PDK is using the request for a full recount more as an instrument to cast doubt on the election result than as a claim supported by facts, given that PZAP dismissed the complaint as unfounded, and whether this reflects a lack of confidence within PDK itself in the electoral process and in the results of its own candidates.

Burjani: There must be serious irregularities that could affect the integrity of the electoral process

On this issue, lawyer Blerim Burjani spoke to “Bota sot.”

According to him, dissatisfaction among certain individuals may exist, but strong evidence affecting the integrity of the electoral process is needed in order to request a vote recount.

“Yes, there is dissatisfaction from certain individuals, but in order to proceed to a vote recount, there must be strong reasons and evidence. In such cases, there must be serious irregularities that could affect the integrity of the electoral process,” he said.

Burjani underlines that a recount or a challenge to election results cannot be requested merely on the basis of suspicions or dissatisfaction, but must be supported by evidence and concrete facts, while the final decision is made by PZAP after reviewing all the circumstances and relevant reports.

“To assess whether there are grounds for a recount or for contesting the result, the Electoral Complaints and Appeals Panel (PZAP) decides, based on the investigations it conducts, the reports of the Central Election Commission (KQZ) and, when necessary, in cooperation with law enforcement bodies.

Therefore, in order to request a recount or challenge the election result, serious facts and concrete evidence must be presented. These requests may be submitted by political entities, but also by their parliamentary candidates,” Burjani told “Bota sot.”

In a statement to “Bota sot,” political analyst Faton Mehmeti assesses that PDK may have chosen not to push further the idea of a full recount, out of fear that such a process would reveal changes in the ranking of candidates and deepen internal debates and dissatisfaction.

“If PDK’s request is analyzed, I think the main reason was to avoid further opening the issue of the ballot boxes and the recount process. If a full recount had taken place, considerable changes could have emerged in the candidates’ results, which would have opened new debates within the party,” he said.

The analyst adds that PDK, in all likelihood, sought for the entire electoral process to conclude as quickly as possible in order to avoid further tensions, stressing that this time the disagreements and dissatisfaction are mainly developing within the party itself and among its candidates.

“For this reason, I believe the aim was for the process to be closed as quickly as possible and not prolonged further. I do not think there was any other essential reason. Within PDK there have always been competitions and internal dissatisfaction after elections, but this time it seems the clashes are not coming from rival parties, but from the party’s own candidates and structures.

This shows that internal competition has been strong and that debates over the result are taking place mainly within the political entity itself,” analyst Mehmeti concluded to “Bota sot.”

Sipas tij, pakënaqësitë e individëve të caktuar mund të ekzistojnë, por për të kërkuar rinumërim votash nevojiten prova të forta që prekin integritetin e procesit zgjedhor.

“Po, ka pakënaqësi nga individë të caktuar, por që të shkohet në rinumërim të votave duhet të ekzistojnë arsye dhe prova të forta. Në raste të tilla, duhet të ketë parregullsi serioze që mund të ndikojnë në integritetin e procesit zgjedhor”, u shpreh ai.

Burjani nënvizon se rinumërimi ose kontestimi i rezultateve zgjedhore nuk mund të kërkohet vetëm mbi bazën e dyshimeve apo pakënaqësive, por duhet të mbështetet në prova dhe fakte konkrete, ndërsa vendimin përfundimtar e merr PZAP pasi shqyrton të gjitha rrethanat dhe raportet përkatëse.

“Për të vlerësuar nëse ka bazë për rinumërim apo kontestim të rezultatit, vendos Paneli Zgjedhor për Ankesa dhe Parashtresa (PZAP), duke u bazuar në hetimet që zhvillon, raportet e Komisionit Qendror të Zgjedhjeve (KQZ) dhe, kur është e nevojshme, në bashkëpunim me organet e rendit.

Prandaj, për të kërkuar rinumërim ose për të kontestuar rezultatin zgjedhor, duhet të paraqiten fakte serioze dhe dëshmi konkrete. Këto kërkesa mund të parashtrohen nga subjektet politike, por edhe nga kandidatët e tyre për deputetë”, foli Burjani për “Bota sot”.

Në një prononcim për “Bota sot”, analisti politik Faton Mehmeti vlerëson se PDK-ja mund të ketë zgjedhur të mos e shtyjë më tej idenë e rinumërimit të plotë, nga frika se një proces i tillë do të nxirrte ndryshime në renditjen e kandidatëve dhe do të thellonte debatet dhe pakënaqësitë e brendshme.

“Nëse analizohet kërkesa e PDK-së, mendoj se arsyeja kryesore ka qenë shmangia e hapjes së mëtejshme të çështjes së kutive dhe procesit të rinumërimit. Në rast se do të bëhej një rinumërim i plotë, mund të dilnin në pah ndryshime të konsiderueshme në rezultatet e kandidatëve, gjë që do të hapte debate të reja brenda parties”, foli ai.

Analisti shton se PDK-ja, me gjasë, ka synuar që i gjithë procesi zgjedhor të përfundojë sa më shpejt për të shmangur tensione të tjera, duke theksuar se këtë herë mosmarrëveshjet dhe pakënaqësitë po zhvillohen kryesisht brenda vetë partisë dhe ndërmjet kandidatëve të saj.

“Për këtë arsye, besoj se synimi ka qenë që procesi të mbyllet sa më shpejt dhe të mos zgjatet më tej. Nuk mendoj se ka pasur ndonjë arsye tjetër thelbësore. Brenda PDK-së ka pasur gjithmonë gara dhe pakënaqësi të brendshme pas zgjedhjeve, por këtë herë duket se përplasjet nuk po vijnë nga partitë kundërshtare, por nga vetë kandidatët dhe strukturat e partisë.

Lawyer Gazmend Halilaj, in a statement to “Bota sot”, said that Haxhiu and Kryeziu’s complaint should be seen as an effort to guarantee transparency and accuracy in the electoral process, with the main emphasis on the ranking of candidates within PDK.

According to him, procedures related to complaints and recounts may slow the certification of the results, but remain necessary to ensure the legitimacy of the electoral process and the establishment of institutions on proper legal grounds.

Halilaj said: “Bekim Haxhiu and Qëndrim Kryeziu’s complaint to the ECAP should first and foremost be seen as an effort to ensure transparency and accuracy in the electoral process. However, the fact that the request comes from candidates of the same party and concerns preferential votes for deputies shows that this is mainly a matter of the internal ranking of PDK candidates and not the overall election result.

However, the delays are not directly related to changing the balance of political forces, but to the completion of all legal procedures that guarantee the legitimacy of the result. The more complaints and recounts there are, the longer the certification process may be extended, which could affect the deadlines for the establishment of institutions,” the lawyer stressed.

He added that the claims of vote manipulation within PDK, for the moment, remain at the level of suspicion until there is concrete evidence.

In his statement to “Bota sot”, Halilaj said: “As for the claims of vote manipulation within PDK, such conclusions cannot currently be drawn without concrete evidence and without a decision from the competent institutions. The existence of counting errors does not necessarily imply manipulation; they may be the result of human error during the counting process. However, the very request for a recount shows that there is mistrust among some candidates regarding the way preferential votes were administered. If a full recount were to reveal considerable differences, then serious questions would be raised about the integrity of the counting process within this party. Until then, it is more accurate to speak of suspicions and demands for transparency than of proven manipulation”.

On the other hand, analyst Faton Mehmeti told the newspaper that the complaints of PDK candidates to the ECAP are not coincidental and that, according to him, there are serious suspicions of vote manipulation within the party.

He assessed that the ECAP should proceed with a recount of the votes of PDK candidates so that the process is transparent and fair.

Mehmeti told “Bota sot”: “It is already known that PDK is known for the theft it carries out within the party itself, with candidates from the same party stealing votes from one another, which is not surprising.

So I believe there must have been many elements that led the deputies in question to turn to the ECAP, and so I believe and am convinced that there has been pronounced manipulation from within PDK, but there are suspicions and manipulation within other parties as well, yet within PDK there certainly is because they have become well-practiced at this, therefore I expect the ECAP to count all the votes of PDK deputies because there truly have been abuses.

I believe that former deputy Haxhiu must have facts to bring about a fair decision in his favor if the votes of all PDK candidates are counted.

In this sense, this may delay for a certain period the official announcement of the election results by the CEC, but I believe it is entirely right for there to be a clean process for all candidates who participated in this process,” he stressed to “Bota sot”.

Sipas tij, procedurat që lidhen me ankesat dhe rinumërimet mund ta ngadalësojnë certifikimin e rezultateve, por mbeten të domosdoshme për të siguruar legjitimitetin e procesit zgjedhor dhe konstituimin e institucioneve mbi baza të rregullta ligjore.

Halilaj u shpreh: “Ankesa e Bekim Haxhiut dhe Qëndrim Kryeziut në PZAP duhet parë para së gjithash si një përpjekje për të siguruar transparencë dhe saktësi në procesin zgjedhor. Megjithatë, fakti që kërkesa vjen nga kandidatë të së njëjtës parti dhe lidhet me votat preferenciale për deputetë, tregon se bëhet fjalë kryesisht për një çështje të renditjes së brendshme të kandidatëve të PDK-së dhe jo për rezultatin e përgjithshëm zgjedhor.

Megjithatë, vonesat nuk lidhen drejtpërdrejt me ndryshimin e raportit të forcave politike, por me përfundimin e të gjitha procedurave ligjore që garantojnë legjitimitetin e rezultatit. Sa më shumë ankesa dhe rinumërime të ketë, aq më shumë mund të zgjatet procesi i certifikimit, gjë që mund të ndikojë në afatet për konstituimin e institucioneve”, theksoi avokati.

Ai shtoi se pretendimet për manipulim të votave brenda PDK-së, për momentin, mbeten në nivel dyshimesh derisa të ketë prova konkrete.

Në deklaratën e tij për “Bota sot”, Halilaj tha: “Sa i përket pretendimeve për manipulim të votave brenda PDK-së, aktualisht nuk mund të nxirren përfundime të tilla pa prova konkrete dhe pa një vendim të institucioneve kompetente. Ekzistenca e gabimeve në numërim nuk nënkupton domosdoshmërisht manipulim; ato mund të jenë rezultat i gabimeve njerëzore gjatë procesit të numërimit. Megjithatë, vetë kërkesa për rinumërim tregon se ekziston mosbesim nga disa kandidatë ndaj mënyrës se si janë administruar votat preferenciale. Nëse rinumërimi i plotë do të evidentonte dallime të konsiderueshme, atëherë do të shtroheshin pyetje serioze mbi integritetin e procesit të numërimit brenda kësaj partie. Deri atëherë, është më e drejtë të flitet për dyshime dhe kërkesa për transparencë sesa për manipulim të provuar”.

Në anën tjetër, analisti Faton Mehmeti deklaroi për gazetën se ankesat e kandidatëve të PDK-së në PZAP nuk janë të rastit dhe se, sipas tij, ekzistojnë dyshime serioze për manipulim votash brenda partisë.

Ai vlerësoi se PZAP duhet të procedojë me rinumërimin e votave të kandidatëve të PDK-së, në mënyrë që procesi të jetë transparent dhe i drejtë.

Mehmeti u shpreh për “Bota sot”: “Tashmë është e njohur që PDK për hajninë që e zhvillon brenda vet partisë, kandidatë e të njejtës parti që i vjedhin vota njëri-tjetrit, gjë që nuk është befasi kjo.

Kështu që besoj se duhet të ketë pasur shumë elemente që deputetët në fjalë pra i janë drejtuar PZAP-it, kështu që besoj dhe jam i bindur që ka pas manipulime të theksuara nga brenda PDK-së, mirëpo ka dyshime edhe ka manipulime edhe brenda partive tjera, po brenda PDK-së sigurisht që ka sepse ia kanë marrë dorë kësaj pune, prandaj une pres që PZAP t’i numëroj të gjitha votat e deputetëve të PDK-së sepse me të vërtetë ka pasur keqpërdorime.

For its part, the CEC had requested that the complaints be rejected, explaining that the recount of 185 polling stations constituted a legal oversight mechanism and not proof of the existence of systematic irregularities. According to the CEC, Kryeziu’s claim of 589 additional votes was also unfounded, because the official data showed that he had only two fewer votes after the recount.

In its reasoning, ECAP stressed that the use of a control sample does not create a legal presumption of general inaccuracies in the counting process. The panel explained that a full recount can be ordered only when there is evidence of major and systematic irregularities.

“A full recount cannot be ordered solely on the basis of hypothetical claims or abstract suspicions, but only when facts and objective evidence exist,” the ECAP decision states.

According to the panel’s assessment, the changes identified at the polling stations that underwent recounting were minimal and went in both directions, which does not prove general irregularities.

The parties may challenge these decisions before the Supreme Court of Kosovo within 48 hours from the moment they receive the decision.

Në ankesat e tyre, kandidatët i janë referuar vendimit të Komisionit Qendror të Zgjedhjeve për rinumërimin e 185 vendvotimeve të rregullta, që përbëjnë rreth 7.41 për qind të 2,498 vendvotimeve gjithsej. Ata kanë argumentuar se gabimet e konstatuara në këtë mostër mund të tregonin për parregullsi edhe në vendvotime të tjera.

Nga ana e saj, KQZ kishte kërkuar që ankesat të refuzoheshin, duke sqaruar se rinumërimi i 185 vendvotimeve përbënte një mekanizëm ligjor kontrolli dhe jo provë të ekzistencës së parregullsive sistematike. Po sipas KQZ-së, pretendimi i Kryeziut për 589 vota shtesë nuk qëndronte, sepse të dhënat zyrtare tregonin se ai kishte vetëm dy vota më pak pas rinumërimit.

Në arsyetimin e tij, PZAP ka theksuar se përdorimi i një mostre kontrolluese nuk krijon prezumim juridik për pasaktësi të përgjithshme në procesin e numërimit. Paneli ka sqaruar se rinumërimi i plotë mund të urdhërohet vetëm kur ka prova për parregullsi të mëdha dhe sistematike.

“Nuk mund të urdhërohet rinumërimi i plotë vetëm mbi bazën e pretendimeve hipotetike apo dyshimeve abstrakte, por vetëm kur ekzistojnë fakte dhe prova objektive”, thuhet në vendimin e PZAP-së.

Sipas vlerësimit të panelit, ndryshimet e konstatuara në vendvotimet që iu nënshtruan rinumërimit kanë qenë minimale dhe në të dy drejtimet, çka nuk dëshmon për parregullsi të përgjithshme.

Palët mund t’i kundërshtojnë këto vendime në Gjykatën Supreme të Kosovës brenda 48 orëve nga momenti i pranimit të vendimit.

Ai ka bërë të ditur se kjo kërkesë, sipas tij, mbështetet në gjetjet e dala nga procesi i deritanishëm i rinumërimit që është zhvilluar nga Komisioni Qendror i Zgjedhjeve.

“Përshëndetje miq, unë sot kam paraqitur ankesë në Panelin Zgjedhor për Ankesa dhe Parashtresa (PZAP), duke kërkuar rinumërimin e plotë të votave të kandidatëve për deputet të Partisë Demokratike të Kosovës. Kjo kërkesë nuk bazohet në supozime apo pakënaqësi me rezultatin e zgjedhjeve, por në fakte të konfirmuara nga vetë procesi i rinumërimit të zhvilluar nga KQZ”, ka shkruar ai.

Sipas Kryeziut, rinumërimi i 185 vendvotimeve ka evidentuar pasaktësi në numërimin fillestar, ndërsa ka theksuar se nga ky proces atij i janë shtuar 589 vota.

“Rinumërimi i vetëm 185 vendvotimeve, që përfshin rreth 3.52% të votave të PDK-së, dëshmoi se kishte gabime në numërimin fillestar. Edhe në këtë mostër të kufizuar, më janë shtuar 589 vota që nuk i kisha më parë. Duke u bazuar në këtë fakt, i bie 11.3% e votës së PDK-së, që i bie të kem mbi 22 mijë vota, andaj çdo votë ka rëndësi dhe çdo pasaktësi mund të ndikojë drejtpërdrejt në rezultatin përfundimtar”, ka deklaruar ai.

Ai ka vlerësuar se vetëm rinumërimi i plotë i të gjitha votave të kandidatëve të PDK-së mund të sigurojë që mandati parlamentar t’i takojë kandidatit që ka marrë mbështetjen e qytetarëve.

“Për këtë arsye kam kërkuar që të rinumërohen të gjitha votat e kandidatëve të PDK-së që nuk janë përfshirë në rinumërimin e deritanishëm. Vetëm një verifikim i plotë mund të garantojë që mandati parlamentar t’i takojë kandidatit që ka fituar besimin e qytetarëve dhe që çdo votë të numërohet saktë”, ka thënë ai.

Në fund, ai ka kërkuar që ankesa e paraqitur prej tij të shqyrtohet në mënyrë të paanshme nga PZAP-i, duke theksuar se transparenca dhe saktësia në numërim janë thelbësore për integritetin e procesit zgjedhor.
